By using the Haraj platform, you agree to comply with the following terms and conditions. Please read them carefully before posting any ad or dealing with other users through the platform.
Haraj is an online platform that allows users to post ads and communicate with each other. Unless expressly stated otherwise, it is not a party to any contract of sale, purchase or provision of services concluded directly between users. Each user is responsible for exercising appropriate due diligence before completing any transaction, including verifying the identity of the other party, their ownership of the item or right to sell or provide it, the accuracy of the product or service description, its condition, its price, and any licences, approvals or legal restrictions that may apply to it.
When using or accessing the Haraj platform, or posting any ad or content, communicating, or carrying out any transaction through it, all users must comply with all laws, regulations, rules, decisions and orders in force in Australia, whether issued at the federal level or at the level of any state or territory, to the extent they apply to the user's activity or transaction. Using the platform, directly or indirectly, for any unlawful, fraudulent or misleading purpose, or for any purpose that would facilitate or incite the commission of an offence or crime, infringe the rights or interests of any person or entity, or circumvent any legal requirement or restriction, is prohibited.
All ads posted on the Haraj platform must be clear, accurate, truthful and not misleading, and must correctly reflect the nature of the goods or services offered, their condition, specifications, price, availability and any other material information. Users must not post any ad that contains false, exaggerated or misleading information, or that conceals material information likely to affect the other user's decision. Posting duplicate, fake or inactive ads, or ads containing content, goods or services prohibited under Australian law or the platform's policies, or using titles, images, prices or descriptions designed to attract users in a misleading way, is also prohibited. Users are responsible for reviewing their ads and updating or removing them when the information in them changes. In accordance with Australian law, the platform may refuse, amend or remove any ad that breaches these requirements, or take any appropriate action against the associated account.
Users are responsible for ensuring that all information and data they provide or post through the platform, including ads, descriptions, images, prices, specifications, condition, ownership, location and any other details or claims, are correct, accurate, complete and not misleading, and that they have the legal right and authority to post and use them. Users must update any information found to be inaccurate or that has become incorrect, and must remove or correct an ad once the goods or services are no longer available or any of their material details change. Users are also responsible for any content or information they provide to the platform or to other users, without prejudice to any rights, guarantees or obligations that cannot be excluded or limited under Australian law.
Users must not post, upload, send or share any content through the Haraj platform that is unlawful, defamatory, threatening, abusive or misleading; that infringes the rights, privacy or reputation of any person or entity; that infringes intellectual property rights or any other legal rights; that incites violence, hatred or the commission of any offence or crime; or that contains material or information whose publication or circulation is prohibited under applicable Australian laws and regulations. Using the platform to post content intended to harass, intimidate, defraud or impersonate others is also prohibited. To the extent permitted by law, the platform may remove or restrict access to any infringing content and take appropriate action against the associated account.
Users must keep their account login details confidential and secure, including their password and any verification codes or authentication methods linked to the account, must not share them with or make them available to anyone else, and must take all reasonable measures to prevent unauthorised access to their account. Users are responsible for the activities, transactions and content carried out through their account to the extent that these result from their own actions, negligence or failure to take reasonable security measures, and must notify the platform without delay if they suspect their account has been compromised, their login details have been lost, or there has been unauthorised use. Where necessary, and to protect the account, users or the platform, the platform may suspend the account, restrict access to it, or take any appropriate security measure in accordance with Australian law.
To the extent permitted by Australian law, the administration of the Haraj platform may take appropriate and reasonable action against any ad, content or account that breaches these terms and conditions or any of the platform's policies, that is reasonably suspected of breaching applicable laws and regulations, or that may pose a risk to users' safety or rights or to the platform's security. Depending on the nature and seriousness of the breach, the platform may refuse to publish an ad, delete it, hide it or restrict access to it; suspend some account features; restrict, suspend or close the account; or take any other technical or administrative action it considers necessary and reasonable to address the breach or prevent it from recurring. In cases involving unlawful content, fraud, or a threat to the safety of users or the platform, immediate action may be taken without prior notice where necessary and permitted by law. These powers are not exercised in an absolute or arbitrary manner, but in accordance with applicable Australian laws and, as far as possible, in proportion to the nature and seriousness of the breach.
The Haraj platform may amend or update these terms and conditions from time to time where necessary or appropriate to develop the platform or its services, for legal, regulatory or security reasons, or to clarify or improve these terms. The updated version will be published on the platform with its effective date, and users will be notified of material changes by appropriate means. Amendments do not apply retrospectively to rights or obligations that arose before their effective date except to the extent permitted by law. A user's continued use of the platform after the amendments take effect constitutes acceptance of the amended terms, to the extent permitted by Australian law. A user who does not agree to the amendments may stop using the platform and close their account in accordance with the applicable procedures, without prejudice to any rights or guarantees that cannot be excluded or limited under law.
